Terms of Service

1. Acceptance of Terms

By accessing or using PilotMonitoringAI ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PilotMonitoringAI is a subscription-based software product that provides an AI-driven Pilot Monitoring companion for Microsoft Flight Simulator. The Service processes your voice commands in real time to run checklists, deliver callouts, actuate in-sim controls (such as landing gear, flaps, spoilers, and overhead panel switches), verify aircraft state, and provide conversational assistance. The Service includes a desktop tray application and a web portal for account management.

3. Subscriptions & Billing

The Service is offered in multiple subscription tiers on a recurring monthly basis. Each tier provides a different set of features and usage allowance as described on the Plans page, which forms part of these Terms. Payments are processed via PayPal. You may cancel at any time; access continues until the end of the current billing period. No refunds are provided for partial billing periods.

4. Usage Limits

Each subscription tier includes a monthly allowance for AI-powered interactions. When the allowance is exhausted, AI features are paused until the next billing cycle. A grace period may be applied to allow active flight sessions to finish. Unused allowance does not roll over.

5. Account & Device Binding

You are responsible for maintaining the security of your account credentials. Each subscription is licensed to a single user and bound to a single device at a time. You may change your bound device up to three (3) times. Additional device changes require contacting support. Sharing accounts or circumventing device binding is prohibited.

6. Intellectual Property

All software, content, and materials provided through the Service are the property of PilotMonitoringAI and are protected by applicable intellectual property laws. You may not reverse engineer, decompile, or redistribute any part of the Service.

7. Disclaimer & Intended Use

PilotMonitoringAI is designed exclusively for personal, home entertainment, and flight simulation hobby use within Microsoft Flight Simulator. It is not a certified aviation product, training device, or flight training aid, and it is not intended to be used as a substitute for any real-world pilot training, flight instruction, or operational procedures.

The Service does not replicate, replace, or supplement any certified flight crew training programme, type-rating course, or aviation authority-approved curriculum. No information, callout, checklist response, or AI-generated output provided by PilotMonitoringAI should be relied upon in connection with the operation of any real aircraft or any real-world aviation decision.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or non-infringement. PilotMonitoringAI makes no representation that its outputs are aeronautically correct, current, or complete. We expressly disclaim any and all liability arising from decisions, actions, or reliance based on the Service's output.

8. Limitation of Liability

To the maximum extent permitted by law, PilotMonitoringAI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. This includes, without limitation, any loss of virtual aircraft state, progress, or in-sim configuration resulting from actuation commands executed by the Service.

9. Data Processing

The Service processes your voice input locally on your device using speech recognition. Transcribed text and aircraft state data are sent to cloud-based AI services to generate responses. Voice audio is not transmitted to or stored on any external server. We do not persistently store your flight telemetry, routes, or recordings. Usage metrics (interaction counts) are retained for billing purposes only.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behaviour. You may delete your account at any time by contacting support.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or the web portal.
